Revised Contract Document Amends the Engineer-Consultant Relationship

The Engineers Joint Contract Documents Committee has released the 2014 edition of E-570, the Agreement Between Engineer and Consultant for Professional Services.

The update was completed with an eye to last year’s revision of EJCDC’s construction documents, the C-series. The document sets the terms for delegating to a consultant a portion of services as specified in a prime engineering agreement, like E-500, the Agreement Between Owner and Engineer for Professional Services. The scope allows for both engineering as well as related services, including landscape architecture.

The revised document also:

  • Accepts the concept of “constructor” as a broad, catchall term for everybody participating in construction at the site;

  • Has matching clauses with other construction documents to determine responsibility when reviewing a portion of the work; and

  • Includes a specific clause to resolve professional liability concerns between an engineer and a consultant.

EJCDC is a joint organization of NSPE, the American Society of Civil Engineers, and the American Council of Engineering Companies, and has been creating standard documents since 1975.
