Protecting Volunteer Professional Engineers: Advocating for Good Samaritan Laws in DC

In December, NSPE engaged with the staff at the DC Homeland Security and Emergency Management Agency regarding a bill introduced in the DC legislature in 2024. While the bill stalled, it is expected to be reintroduced in 2025, and NSPE is actively working to ensure that model language from its position on Good Samaritan laws is included. NSPE consulted with agency staff to gauge the suitability of incorporating these provisions should the legislation progress.

Good Samaritan laws protect volunteers—like professional engineers (PEs)—who step up in times of crisis, ensuring they can offer their expertise without fear of liability. NSPE’s position is clear: PEs who volunteer in emergency situations at the request of public officials should be shielded from liability for any potential injuries, damages, or losses resulting from their actions, provided they are not acting with intentional misconduct. This protection allows engineers to contribute their skills confidently in the aftermath of disasters, including structural assessments and other critical engineering services, which are vital to restoring communities.

NSPE provided staff at the DC Homeland Security and Emergency Management Agency with key information to reinforce the position statement, highlighting how the Good Samaritan provisions empower committed, knowledgeable professionals to respond effectively in emergencies. 

As the proposal continues to develop, NSPE will continue to monitor developments and collaborate with stakeholders to advocate for the inclusion of Good Samaritan protections, ensuring that engineers who volunteer in emergency situations are recognized and protected for their contributions.
